How Does this Process Work?

Weeks 1-2

Our attorneys, with support from our law clerks typically sourced from Michigan State University’s Center for Anti-Counterfeiting and Product Protection program (A-CAPP) search third-party platforms for infringing content, screenshot and organize the evidence, and perform test buys.

Week 3

We work with the client to verify the infringement and execute declarations to be used in support of our impending Motion for Temporary Restraining Order.

Weeks 4-6

We draft and file the Complaint, Motion for Temporary Restraining Order, Electronic Service, and Expedited Discovery.

Week 6-10

We serve the TRO and subpoenas on the third-party platforms and other service providers, including PayPal, Stripe, Payoneer, and Ant Financial to restrain any financial accounts connected to the infringers.

Weeks 10-13

We complete electronic service, file a Motion for Preliminary Injunction, and eventually, a Motion for Default and Default Judgment on the vast majority of infringers that do not appear and defend. We also work to settle settlements with those relatively few infringers that retain US counsel.

Week 14-16

We work with third-parties to have the frozen funds released to our client in partial satisfaction of the judgments.
