According to Gerhardt and McClanahan’s study:

• Inexperienced trademark applicants without a lawyer saw their trademarks published only 57% of the time.
• Experienced trademark lawyers successfully published their clients’ trademarks 83% of the time.

• Cost: Hiring a trademark lawyer the first time, will save you the time and money of having to repeat the process.
• Protection: Having your trademark published as soon as possible is the best way to protect yourself. It is crucial to get your trademark published the first time to avoid any potential disputes.
• U.S. Patent and Trademark Office Recommendation: The USPTO is in charge of publishing trademarks, and it recommends hiring an experienced trademark attorney.
• Enforcement after the fact: Getting your trademark published is just one step towards protecting yourself. You are still responsible for enforcing your trademark in the event of infringement. Having an experienced trademark lawyer publish your trademark can help reduce the future costs of enforcement and assist you in the enforcement process.
