Receiving a Notice of Suspension from Amazon — or any online sales platform like Walmart — can be devastating. But you have options and, in some cases, you can have the decision reversed and be “up and running” within 24 hours. The best option is to consult with an Amazon Suspension Appeal attorney like the ones here at Revision Legal. We can evaluate your circumstances and provide the legal help you need for an Amazon Account Reinstatement. Here are a few “do-s” and “don’t-s” if you have received a Notice of Suspension.

Do remain calm and don’t panic

You have options. Thus, you should remain calm and do not panic. Filing an Appeal is the main option, and that can be done quickly. Obviously, how the Appeal is drafted and submitted depends on the reason WHY your account was suspended. For example, maybe there was a mistake and you listed a restricted product. In that sort of case, the Appeal will focus on that mistake and how you will change your internal processes and procedures to make sure it does not happen again. This is the same Amazon Appeal response if other mistakes were made, like not including an image, a detailed description, or using the wrong product category.

Don’t have unreasonable expectations

On the other hand, account suspensions can happen for more complicated reasons. In those cases, it is important not to have unreasonable expectations. Examples here include allegations of intellectual property violations, violations of terms of service, and/or review policies. In these more complicated situations, the Appeal must be drafted very carefully and should contain proper documentation. In cases involving alleged trademark or copyright violations, you will likely need documents from the holders of those intellectual property rights. Serious matters will take longer, and you will definitely benefit from having experienced legal assistance.

Draft your Appeal carefully

Whether the “problem” is reasonably “easy” to fix or more difficult, it is important to draft your Appeal carefully. That is, make sure that all the important sections are in the Appeal and that the Appeal itself is well-written and clearly written. Proper and relevant documentation is also important in many Appeal cases.

Don’t make excuses or “play the victim”

When filing a Suspension Appeal, among the least helpful things to do is make excuses, talk about how “unfair” Amazon is, and/or “play the victim.” If you made a mistake, “own up” to the mistake and ensure that Amazon understands how you will avoid that mistake in the future. Even if your account was hacked or accessed without permission by someone, you still must avoid “playing the victim.” Amazon is not interested in that, since it can be argued that you failed to properly secure your account from hackers or unauthorized personnel. Again, the only successful path forward is explaining to Amazon how, in the future, you will avoid being hacked or having your account accessed by unauthorized persons.

Trademarks are words, designs, symbols, logos, and other things that are used/associated with goods or services that identify the specific commercial source of the goods/services. COCA-COLA, APPLE, and GUCCI are just a few famous examples. If COCA-COLA is on the bottle, consumers know what to expect from the beverage in the bottle. The same for […]
