Looking Ahead: Internet and IP Law Trends for 2016

As we head into 2016, several legal developments deserve close attention from businesses operating in the technology and digital content space.

Data Privacy and Security

The legal landscape for data privacy is shifting rapidly. The Federal Trade Commission continues to expand its enforcement activity around data security practices, and state data breach notification laws have proliferated across nearly every jurisdiction. The European Court of Justice’s invalidation of the EU-US Safe Harbor framework in October 2015 created significant compliance uncertainty for companies that transfer personal data across the Atlantic. Businesses that collect and process consumer data need to audit their practices and update their privacy policies to reflect current legal requirements.

DMCA Reform

Copyright industry groups and technology companies have been engaged in a sustained debate about reforming the DMCA’s notice-and-takedown framework. Content owners argue that the current system requires them to send millions of takedown notices only to see the same content re-uploaded immediately—a “whack-a-mole” problem.
